{"id":7352,"date":"2017-07-03T14:56:45","date_gmt":"2017-07-03T09:26:45","guid":{"rendered":"http:\/\/www.lexwarrier.org\/?p=747"},"modified":"2023-07-01T15:58:23","modified_gmt":"2023-07-01T15:58:23","slug":"purchased-for-commercial-purpose-not-consumer","status":"publish","type":"post","link":"https:\/\/lex-warrier.in\/archives\/purchased-for-commercial-purpose-not-consumer.html","title":{"rendered":"Purchased for commercial purpose, not consumer"},"content":{"rendered":"<p><strong>National Consumer Disputes Redressal Commission<\/strong> (hereinafter referred as <strong>NCDRC<\/strong>) while considering the dispute between <strong>EMAAR MGF Land Ltd. <\/strong>and <strong>Banga Constructions Pvt. Ltd.<\/strong>, held that, anyone including a corporation OR a company who has purchased any goods or hired any services <em>for<\/em><em>any commercial purpose, <\/em>then they shall not fall under the definition of <strong>consumer <\/strong>within the meaning of <strong>Section 2 (1) (d) of the Consumer Protection Act, 1986<\/strong>.<\/p>\n<p>In the instant case between <strong>EMAAR MGF Land Ltd. <\/strong>and <strong>Banga Constructions Pvt. Ltd.<\/strong>, an appeal was filed before the <strong>NCDRC <\/strong>by the Developer of a Commercial Complex, known as \u201c<strong>Central Plaza<\/strong>\u201d at<strong>Mohali Hills<\/strong> against an order dated 05.01.2012 passed by the <strong>State Consumer Disputes Redressal Commission, Delhi <\/strong>in Complaint no. C-11\/20, whereby the Appellant has been proceeded against <em>ex parte<\/em> as, in spite of service of notice, it had remained unrepresented when the Complaint was taken up for hearing on that date.<\/p>\n<p>The question came before the <strong>NCDRC<\/strong> is that, the Respondent\/Complainant to satisfy <strong>NCDRC <\/strong>as to how in the first instance the Complaint alleging deficiency in service on the part of the Appellant in not delivering possession of four shops in the said <strong>Commercial Complex<\/strong>, was maintainable under the<strong>Consumer Protection Act, 1986<\/strong>.<\/p>\n<p>Having perused the documents on record, including the allotment letters, <strong>National Consumer Disputes Redressal Commission<\/strong> was of the opinion that the shops acquired by the Respondent Company purely for <strong>commercial purpose<\/strong> and therefore, by no stretch of imagination, the Respondent Company could be said to be a <strong>Consumer within the meaning of Section 2 (1) (d) of the Act<\/strong>.<\/p>\n<p>It is trite that the words \u201c<strong>for any commercial purpose<\/strong>\u201d used in the Section means that the goods purchased or services hired are used or proposed to be used in any activity directly intended to generate profit. It is manifest that the four units booked by the <strong>Respondent Company<\/strong> with the Appellant were meant to be used in some activity directly intended to generate profit.<\/p>\n<p>Therefore, <strong>NCDRC<\/strong> is of the opinion that the Complaint filed by the <strong>Respondent Company<\/strong> under the Act was not maintainable as the <strong>Respondent Company<\/strong> was not a consumer covered under the Act.
