{"id":6451,"date":"2017-07-30T07:39:19","date_gmt":"2017-07-30T02:09:19","guid":{"rendered":"http:\/\/www.lexwarrier.org\/?p=741"},"modified":"2023-07-01T15:58:20","modified_gmt":"2023-07-01T15:58:20","slug":"distinction-between-expiry-date-and-best-before-date","status":"publish","type":"post","link":"https:\/\/lex-warrier.in\/archives\/distinction-between-expiry-date-and-best-before-date.html","title":{"rendered":"Distinction between expiry date and best before date"},"content":{"rendered":"<p>Madras High Court while dismissing a writ petition of <a href=\"http:\/\/www.lexwarrier.org\/writ-of-certiorari-and-duty-to-act-judicially.html\" target=\"_blank\" rel=\"noopener\"><strong>Certiorari<\/strong><\/a> and <a href=\"http:\/\/www.lexwarrier.org\/writ-of-mandamus-and-indian-constitution.html\" target=\"_blank\" rel=\"noopener\"><strong>Mandamus<\/strong><\/a>, observed that, there is a clear distinction between the term <strong>expiry date<\/strong>\u00a0and the <strong>best before<\/strong><strong>\u00a0date<\/strong>, whereas, the <strong>best before date<\/strong>\u00a0signifies the duration for which the product shall remain marketable and retain its\u00a0<strong>specific qualities<\/strong> if <strong>stored in appropriate conditions<\/strong> and on the other hand, \u201c<strong>expiry date<\/strong>\u201d is the date on which the product shall completely cease to have the specific qualities associated with it and shall not remain <strong>marketable<\/strong>.<\/p>\n<p>By virtue of <strong>Clause 1 of the Regulation 1.2<\/strong> of the <strong>Food Safety and Standards (Packaging and Labelling) Regulations, 2011<\/strong> <strong>Best before<\/strong>\u00a0means the date which signifies the end of the period under any <strong>stated storage conditions<\/strong> during which the food shall remain fully marketable and shall retain any specific qualities for which tacit or <strong>express claims<\/strong> have been made and beyond that date, the food may still be <strong>perfectly safe to consume<\/strong>, though its <strong>quality may have diminished<\/strong>. However the food shall not be sold if at any stage the <strong>product becomes unsafe<\/strong>.<\/p>\n<p>Further, by virtue of <strong>Clause 10 of the Regulation 1.2<\/strong> of the <strong>Food Safety and Standards (Packaging and Labelling) Regulations, 2011 <\/strong>\u201c<strong>Use \u2013 by date<\/strong>\u201d or \u201c<strong>Recommended last consumption date<\/strong>\u201d or <strong>Expiry date<\/strong>\u00a0means the date which signifies the end of the estimated period under any stated storage conditions, after which the food probably will not have the <strong>quality and safety attributes<\/strong> normally expected by the <strong>consumers<\/strong> and the food shall not be sold.&#8221;<\/p>\n<p>Court further noted that, petitioner cannot be allowed to mention a single date for both as it would mislead the consumers to think that the product will never lose its quality.<\/p>\n<p><strong>Read the full judgment of <\/strong><a href=\"http:\/\/judis.nic.in\/judis_chennai\/Judge_Result_Disp.asp?MyChk=217123\" target=\"_blank\" rel=\"noopener\"><strong><em>Amrut Distilleries Ltd. v.
