{"id":4736,"date":"2013-12-07T12:15:22","date_gmt":"2013-12-07T06:45:22","guid":{"rendered":"http:\/\/lex-warrier.in\/?p=4736"},"modified":"2023-07-01T15:46:37","modified_gmt":"2023-07-01T15:46:37","slug":"court-s-decision-backed-reasoning","status":"publish","type":"post","link":"https:\/\/lex-warrier.in\/archives\/court-s-decision-backed-reasoning.html","title":{"rendered":"Court \u2019s decision should be backed by reasoning"},"content":{"rendered":"<p align=\"right\"><b>Ipsita Mishra<\/b><\/p>\n<p style=\"text-align: justify;\">The Supreme Court holds that reasons are the heart-beat of any judgment.<\/p>\n<p style=\"text-align: justify;\">To my mind there are four purposes for any\u00a0judgment that is written: &#8211;<\/p>\n<ul>\n<li>clarity of thoughts;<\/li>\n<li>explanation of decision to the parties;<\/li>\n<li>communicate the reasons for the decision to the\u00a0public;<\/li>\n<li>to provide reasons for a Court to consider<\/li>\n<\/ul>\n<p style=\"text-align: justify;\">The principle of natural justice has twin ingredients; firstly, the\u00a0person who is likely to be adversely affected by the action of the\u00a0authorities should be given show cause notice and granted an opportunity of hearing. Secondly, the orders so passed by the\u00a0authorities should give reason for arriving at any conclusion showing\u00a0proper application of mind. Violation of either of them could vitiate the order itself.<\/p>\n<p style=\"text-align: justify;\">In the cases where the Courts have not recorded reasons in the\u00a0judgment, legality, propriety and correctness of the orders by the Court are challenged. The public can have assurance that the\u00a0correcting process is working if results are announced. An\u00a0unreasoned decision has very little claim to acceptance by the defeated party. Moreover, the necessity of stating\u00a0reasons not infrequently changes the results by forcing\u00a0the judges to come to grips with nettlesome facts or\u00a0issues which their normal instincts would otherwise\u00a0cause them to avoid ((Paul D. Carrington, Daniel J\u00a0Meador and Maurice Rosenburg, Justice on Appeal 10\u00a0(West 1976).)).\u201d\u00a0A right to reasons is an indispensable\u00a0part of a sound system of judicial review. It is in accordance with natural justice. This shows that the person is receiving justice as well as it is a valuable discipline for the tribunal ((H.W.R. Wade in the\u00a0book \u201cAdministrative Law, 7th Edition)).<\/p>\n<p style=\"text-align: justify;\">Supreme Court said that the courts should decide on the basis of reasoning and hence should give rationale for the same. The reasons should be such that they demonstrate that the\u00a0decision has been arrived at on an objective consideration. Public policy, morality, justice, precedents etc are taken into account while deriving any conclusion or decision.
