{"id":3622,"date":"2013-07-11T08:37:12","date_gmt":"2013-07-11T03:07:12","guid":{"rendered":"http:\/\/lex-warrier.in\/?p=3622"},"modified":"2023-07-01T15:42:19","modified_gmt":"2023-07-01T15:42:19","slug":"hc-upholds-right-to-education-norm-not-to-fail-child-in-exam","status":"publish","type":"post","link":"https:\/\/lex-warrier.in\/archives\/hc-upholds-right-to-education-norm-not-to-fail-child-in-exam.html","title":{"rendered":"HC upholds Right to Education norm not to fail child in exam"},"content":{"rendered":"<p style=\"text-align: right;\" align=\"right\"><b>Reported by Eira Mishra<\/b><\/p>\n<p style=\"text-align: justify;\"><b>HC upholds RTE&#8217;s norm not to fail child in exam:<\/b> Bombay High Court dismissed a Public Interest Litigation filed before to challenge a provision of the\u00a0Right of Children to Free and Compulsory Education (RTE) Act\u00a0which prohibits failure or expulsion of a child before completion of elementary education i.e. standard eight.<\/p>\n<p style=\"text-align: justify;\">The High Court observed, \u201cA child suffers an intense psychological trauma if he or she is expelled or continued in the same class upon failing in the final examination\u201d while dismissing the PIL. As per section 16 of the Act\u00a0\u201cno child shall be held back or expelled till completion of elementary school (standard eight)\u201d.<\/p>\n<p style=\"text-align: justify;\">Justice DY Chandrachud and Justice SC Gupte said, \u201cThe parliament, which was evidently conscious of the social realities, carefully drafted <a title=\"MHRD\" href=\"http:\/\/mhrd.gov.in\/rti_school\" target=\"_blank\" rel=\"noopener\">section 16 of the Right to Education Act<\/a> so that children are not made victims and don\u2019t lose out on elementary education.\u201d They observed that the policy is fair and proper.<\/p>\n<p style=\"text-align: justify;\">Court observed that \u201cA child who is not allowed to progress to the next standard suffers from an intense psychological trauma resulting in loss of self-worth. Holding back for want of adequate performance assessed with conventional methods like examinations places the child in a position of disadvantage in relation to his or her peers,&#8221;\u00a0Further, \u201cAssessing knowledge merely in terms of performance in examination takes a very narrow view of the purpose of education.\u201d Education must emphasise the need to initiate the child into a holistic pattern of development.<\/p>\n<p style=\"text-align: justify;\">The court added that it is not always a child\u2019s fault when he fails an exam. It said, \u201cIn many cases, children are failed or held back due to the inability of parents to shoulder the financial burden of the children\u2019s education.\u201d Citing the above reasons, the
